Preparing an Effective Postnuptial Agreement
The fundamental difference between a postnuptial agreement and a prenuptial agreement is the fiduciary duty that spouses owe each other. In a post nuptial agreement, a duty to treat the other spouse fairly will be read into any agreement.
Drafting a postnuptial agreement can offer you and your spouse some security in the event that the marriage ends in a divorce. As with prenuptial agreements, your attorney will need an adequate amount of time to draft an effective postnuptial agreement.
